PRIVACY POLICY – Informative document article 13 EU Reg. 2016/679 – GDPR – Circular
for the processing of personal data collected from the data subject

In accordance with the EU Regulation 2016/679 (General Data Protection Regulation), we furnish you with the necessary information concerning the processing of the personal data provided. This circular shall not be considered valid for other websites potentially accessible through the links provided on the websites under the domain of the owner, who shall not be considered in any case responsible for third-party websites. This circular pursues Article 13 of the EU Regulation 2016/679 (General Data Protection Regulation), the Directive 2002/58/EC as updated by the Directive 2009/136/EC concerning cookies and the Measures of the Authority granting the personal data protection of May the 8th, 2014, concerning cookies.

Processable personal data: «personal data»: any piece of information concerning an identified or identifiable natural person; is considered as identifiable any natural person that can be directly or indirectly be identified, especially concerning identifiers such as the name, an identification code, data related to the location, an online identifiers and one or more elements concerning the physical, fisiologic, genetic, psychic, economic, cultural or social identity; (C26, C27, C30).

  1. THE “TITLE HOLDER” OF THE PROCESSING

  1. PROCESSING PURPOSES AND LEGAL BASIS AND LEGITIMATE INTEREST

According to article 6, clause 1, letters b) and f), the personal data voluntarily provided shall be
processed for the following purposes, until opposition:

The data processing is based on Article 6, clause 1, letter f): (considered 47), considering the reasonable expectations of the data subject at the moment and setting of the personal data collection, should the subject reasonably expect a process for such an use.

  1. 4. PROCESS MODALITIES – STORAGE

The processing shall be executed in printed, electronic and physical format, with modalities and tools granting the maximum security and privacy, by subjects specifically appointed according to Article 32 of the EU Regulation 2016/679. According to Article 5, clause 1, letter e) of the EU Regulation 2016/679, the personal data collected shall be stored in order to identify the data subjects within the time to fulfill the objective of the procession of these data. The storage of the provided personal data depends on the processing purposes:

  1. COMMUNICATION, DISTRIBUTION AND TRANSFERRING OF DATA ABROAD

  1. AUTOMATIC PROCESS AND PROFILING

The processing of your personal data shall not be subdued to automatic processes nor profiling activities.

  1. NATURE AND REFUSAL OF THE PROVISION

Beside what has been specified concerning browsing data, the user is free to provide his/her personal data. The data provision is elective but necessary to perfectionate the sending of information request and getting contacted by the processing owner. The missed provision of the data marked with the symbol* may entail the impossibility of fulfilling the requests obtaining or benefiting from the services of the processing title holder.

  1. RIGHTS OF THE DATA SUBJECTS

● personal data have been illicitly processed;
● personal data shall be deleted in order to fulfill a legal obligation expected by the European
or National law the title holder is subjected to;
In case the processing title holder published the personal data and he/she is obliged to delete them,
he/she shall inform the other title holders processing the personal data about the cancellation request
for any link, copy or reproduction of these data;
d) Right to limitate the processing if:
● the data subject contests the accuracy of the personal data within the time necessary for the
title holder to verify the accuracy of these data;
● the processing is illicit and the data subject contests the cancellation of the personal data,
requiring instead limits to their use;
● although the processing title holder no longer needs them for the processing purposes, the
data subjects needs the personal data for the inspection, exercise or defense of a right in
court;
● the data subject contested the processing, waiting for an inspection concerning the possible
prevalence of the processing title holder legit reasons on those of the data subjects.
e) Right to complain to the Authority granting the personal data protection, according to the
procedures and indications issued on the Authority official website, www.garanteprivacy.it .
f) Right to the data portability, that is the right to receive on a format which is structured, commonly
used and readable from an automatic device the personal data concerning him/her, provided by a
processing title holder and possibly transmitted to another processing title holder, should the
process be based on the consent or on a contract and be executed with automatic devices. If
technically possible, the data subject has the right to the direct data transmission from one
processing title holder to the other.
g) Right to contest at any time the personal data processing, including profilation, especially in
case:
● the process is based on a legit interest of the title order, prior to an explicit reason for the
opposition;
● personal data are processed for direct marketing purposes.
h) Right not to be subdued to a decision exclusively based on automatised processing, including
profilation, except in case the decision: is necessary for the conclusion or execution of a contract
between the data subject and the processing title holder, it is authorized by the European or National
law the processing title holder is subjected to or based on the explicit consent of the data subject.
i) Right to revoke the consent at any time.
The exercise of these rights is not subjected to any bond and it is free.
9. MINORS
This Website and the Title Holder Services are not intended for minors and the Title Holder does
not intentionally collect personal data referring to minors. Should data concerning minors be
unintentionally recorded, the Title Holder shall promptly delete them, upon users request.
